A Message from the Department of Medical Assistance Services (DMAS) Image

The pandemic-related flexibility that allows reimbursement to spouses or parents of children under age 18 for providing personal care services was scheduled to end on November 10, 2023.

The Centers for Medicare & Medicaid Services (CMS) approved the delay of the implementation of the new Legally Responsible Individuals (LRI) requirements until March 1, 2024 to allow families to learn more, adjust to this change, and have additional time to find an alternate Attendant and support services.

Current LRIs may continue working and be paid during the implementation of the new LRI process.

We encourage Employers of Record (EOR) to continue searching for an alternate Attendants. EORs will have to show their recent efforts to hire an Attendant and demonstrate no one else is available.

Again, the care of Medicaid Members and the support to their families is a priority of the governor and the Department of Medical Assistance Services (DMAS). We will continue to work with families to help them understand the requirements and prepare for the March 2024 date. DMAS is committed to helping families adjust to this next chapter.
